TOML’s Privacy Policy
The IOC attaches great importance to privacy and undertakes to protect all the personal data it processes through TOML in compliance with data protection laws.
By having access to, registering on, navigating or otherwise using TOML, requesting the delivery of photographs, illustrations, audio, audio-visual materials and/or any other content or material made available to you through TOML (the “IOC Content”), and/or submitting your “Search Request” within TOML, you understand and acknowledge that you provide your personal data to the IOC. The IOC will collect and process your personal data in accordance with the present Privacy Policy, as well as with the TOML IOC Content License Agreement , where applicable, the TOML’s Terms of Use and, unless otherwise provided in any of the foregoing terms, with the IOC Privacy Policy available here.
1. Registration and processing of your personal data
The use of TOML requires that you register with the IOC and provide the IOC with certain information about yourself, and/or a third party including certain personal data such as
- First name
- Last name
- Job title
- Company name
- Email address
- Phone number (not mandatory)
- Postal address
- as well as other information as deemed necessary by the IOC for your use of TOML.
By providing the above information and/or personal data of any third party to the IOC, you hereby represent and warrant that you have been duly authorized to act on behalf of such third party and have appropriately informed such third party of the processing of his/her information and/or personal data in accordance with this Privacy Policy.
2. “Deliver to someone else” functionality
The functionality “Deliver to someone else” allows you - as TOML user - to enter the customer details of a third party who doesn’t have access to TOML so that the IOC can send to such a third party the IOC Content that you have requested.
Prior to submitting any personal data on behalf of a third party, you hereby represent and warrant that you have informed such third party, obtained her/his authorisation to act on her/his behalf and ensured that such third party understands the Privacy Policy and accepts the IOC Content License Agreement and, where applicable, the TOML’s Terms of Use. FAILURE TO PROVIDE THIS INFORMATION AND TO OBTAIN THE NECESSARY AUTHORISATION FROM THE THIRD PARTY MAY RESULT IN YOUR BECOMING LIABLE PURSUANT TO SECTION 8 OF THE IOC CONTENT LICENSE AGREEMENT (INDEMNITY).
3. Purposes of processing of your personal data
The IOC commits to process your personal data always in a transparent, lawful and proportional manner and solely for the following purposes (the “Authorized Purposes”):
- Enabling your access, registration, navigation and use of TOML;
- Execute your requests on TOML;
- Handle your contact requests;
- Delivery of the IOC Content;
- Receive your payment in consideration of IOC Content;
- Performance and enforcement of the IOC Content License Agreement and/or the TOML's Terms of Use;
- Maintenance and improvement of TOML;
- Compilation of statistics in order to improve the quality of the services offered to users on TOML;
- Upon your consent, provide you information about the activities of the IOC and the Olympic Movement.
4. Hosting of your personal data and data recipients
The IOC is based in Switzerland and all the personal data you submit to the IOC will be hosted and processed by the IOC and its subcontractors in Switzerland, the United Kingdom and/or within the European Union, subject to the below.
Even though the data collected is generally processed in the European Union, the United Kingdom or in Switzerland (which provides a level of protection equivalent to that of the European Economic Area in accordance with the European Commission decision of 26 July 2000), the IOC may also transfer your data, for the Authorized Purposes, to third party recipients, some of which may be based in countries whose laws do not provide data protection equivalent to that offered through the rules in force in the European Union, the United Kingdom and in Switzerland, such as the United States of America. This may arise when the companies that assist the IOC in operating TOML and/or supplying the services provided therein can access your personal data from third countries outside the EEA (like in the USA). Before transmitting your personal data from Switzerland, the United Kingdom or the European Union to other countries, the IOC implements the protection mechanisms recognised by applicable data protection and privacy laws, such as the use of standard contractual clauses. Please consult the IOC Privacy Policy available here in case you need more information about this.
The IOC reserves the right to disclose your personal data to third countries without adequate level of data protection pursuant to statutory derogations such as contractual necessity, or based on a judgment or decision rendered by a law enforcement authority or if the IOC believes in good faith that it is required to do so in order to comply with applicable laws.
In order to run the TOML platform and provide you with the associated services in accordance with this Privacy Policy and applicable terms and conditions, the IOC may share some of your personal data with service providers and third parties, as set forth in section "Who do we share your information with?" in the IOC Privacy Policy, typically in connection with:
- customer data infrastructure and back-end, platform development services and general IT services;
- hosting services;
- customer support services and customer relationship management;
- analytics and audience measurement services; and
- email communications and push notification services.
5. Data security
The IOC is committed to endeavor the best possible level of security, availability, confidentiality, integrity and traceability of your personal data and takes adequate technical and organizational measures to protect your personal data against the risks of damage, destruction, loss or unauthorized access.
6. Cookies
When accessing TOML, the IOC will use only those cookies that are strictly necessary to allow you to navigate the TOML platform and use its features. These cookies are necessary for TOML to function and may not be deactivated in the IOC’s systems. They are generally generated only in response to actions by you on TOML that constitute a request for services, such as completing forms. You may configure your browser to be alerted to the presence of cookies or to block them, but blocking them will cause certain parts of TOML not to function properly.
7. Data retention
The IOC will retain your personal data only as long as necessary for the Authorized Purposes. IOC will retain anonymous data as soon as possible. The IOC reserves the right to retain your personal data for a longer period of time for enforcement purposes, if statute of limitation allows.
8. Changes to this Privacy Policy
The IOC reserves the right to change any of the terms and conditions contained in the present Privacy Policy, at any time and in its sole discretion. When we make changes, we will revise the "last updated" date at the bottom of the Privacy Policy. Any changes will be effective immediately upon posting on TOML. Your continued use of TOML following the posting of changes will constitute your acceptance and acknowledgement of such changes. We encourage you to review TOML’s Privacy Policy whenever you visit TOML.
9. How to exercise your right
To exercise your data protection rights, or for any question related to this Privacy Policy, you can contact the IOC through the IOC’s dedicated portal.
You can also access and update your personal data at any time by accessing your account. It is your responsibility to ensure that your personal data are accurate and up-to-date and to undertake or notify the IOC in case any changes are required.
